By submitting a registration form to the ICFA for an ICFA Event or Conference ( 'Event' ) each registrant acknowledges having read the ICF Pledge of Ethics and ICF Standards of Conduct and these Terms and Conditions. The registrant accepts these as part of the agreement between ICFA and the registrant.
1.1 Registration for an Event only occurs when ICFA communicates its acceptance of the registration submitted. ICFA may, at its sole discretion, refuse registration of any registrant without giving any cause or explanation.
1.2 Registration closes at the time and date specified by ICFA. ICFA, in its sole discretion may accept late registrations on alternative terms and conditions. No assurance is given to registrants registering late that they will be able to attend all programmed events or that materials and merchandise to be made available to Event registrants will be available for those registering late.
1.3 Unless specified otherwise, Event registration and other fees or charges will be in Australian dollars and will include GST. Payment of registration fees are to be made in cleared funds by the date(s) notified by ICFA. In cases where a payment is dishonoured, the registrant or payer agrees to pay a $50 fee to ICFA to cover bank or other fees as a result of the dishonour.
1.4 The registrant agrees that registration for an Event is for the business or professional purposes of the registrant.
1.6 Registration is for the person registered and may not be shared with any other person during the Event, except to the extent a substitute registration is permitted under clause 2.8 of these Terms and Conditions.
2.1 ICFA may, in its sole discretion, and for any reason, postpone or cancel an Event at any time. If the Event is cancelled prior to the scheduled commencement a refund of the registration fee paid by the registrant will be made. If the remainder of an Event is cancelled during the Event a pro rata refund of the registration fee will be made, the pro rata apportionment to be equivalent to the period of the Event cancelled as a portion of the entire Event period. No other compensation is payable to a registrant for postponement or cancellation of an Event.
2.2 A registrant may cancel registration ( by email to if an ICFA Conference cancellation or to if cancellation of any other event or by post for any Event addressed to ICFA Inc PO Box 7151 Kariong NSW 2250 Australia ), if received by ICFA prior to the start date of the Event.
2.3 If cancellation of a registration is received by ICFA at least 21 clear days before the Event, then it will refund the registration fees paid by the registrant ( less 25% to cover administration and other costs )
2.4 If cancellation of a registration is received by ICFA between 20 clear days and 7 clear days before the Event, then it will refund the registration fees paid by the registrant (less 50% to cover administration and other costs).
2.5 If cancellation of a registration is received by ICFA less than 7 clear days before the Event, then there will be no refund of any portion of the registration fees paid by the registrant, unless there are special circumstances. 'Special circumstances' are unforeseen medical circumstances which are verified by a registered medical practitioner to the reasonable satisfaction of ICFA, or other extraordinary circumstances or hardship, which in all cases prohibit reasonable attendance and participation at the Event in the opinion of ICFA.
2.6 In determining a request for refund on the basis of special circumstances ICFA may, in its sole discretion, refund all of the registration fee paid by the registrant, or part after deduction of any administration or other costs ( or, with the agreement of the registrant, credit the fee paid towards the registration fees payable for another ICFA Event). ICFA's decision will be final.
2.7 If a registrant ceases their participation during an Event, for any reason, no refund will be made.
2.8 A registrant may apply to ICFA for another person to attend in place of the registrant. If ICFA accepts that substitute person, then the substitution may be made on payment to ICFA of a $45 administration fee.
3.1 All copyright and other intellectual property rights in the papers, processes, information and materials (Information' ) provided or available at an Event remain the intellectual property of ICFA or the Event speaker, presenter or facilitator who has made available such Information. It may not be copied, altered or distributed in any form without the express written permission of the legal owner(s) of the copyright or other intellectual property rights in that Information. All Information is subject to copyright or intellectual property protection.
3.2 ICFA makes no warranty, representation or undertaking, whether expressed or implied, nor does it assume any legal responsibility for the accuracy, completeness or usefulness of this Information. ICFA accepts no liability, whether direct or indirect, for any loss or damage a person suffers because that person has directly or indirectly relied on any Information obtained or received at an Event.
4.1 ICFA does not guarantee the accuracy of any Event programme or other published material or information nor the presentation of topics, speakers or other presenters or facilitators at an Event. While reasonable attempts will be made to keep to the published Event programme or to maintain previously published information, changes may have to be made, without notice, due to any person's unavailability; because of an inaccuracy; or for any other reason.
5.1 Any record of registrant attendance at an Event is made voluntarily by each registrant and may be incorporated into an attendee list made available to Event attendees for their information only. The registrant's Event attendance information, name, and contact details may also be maintained and used by ICFA ( and to that end made available too to the Event organizer for audit and Event operational purposes, and to Event accommodation providers for room booking and conference option purposes). ICFA may also add the registrant's name and contact details to ICFA's database and that of the International Coach Federation in order to record and allocate attendance accreditation points and to notify the registrant of future ICF or ICFA events.
5.2 ICFA will not sell, rent or lease a registrant's personally identifiable information to others. Personal information collected by ICFA is otherwise treated as confidential and is protected by applicable privacy legislation. Any information provided will be used only for the purpose intended unless otherwise required by law.
6.1 Each registrant undertakes not to promote, sell, display or distribute in any way at an Event any product, service, merchandise or other materials unless the registrant has express written permission from ICFA and does so in accordance with the terms and conditions of that permit.
7.1 ICFA may publish separately ( including on its website ) operational 'house' rules and requirements to support the efficient running of an Event and the comfort and well being of Event participants. Breach of any of those rules or requirements will constitute a breach of these Terms and Conditions.
8.1 In this clause 'Provider' means ICFA and each Event host, service provider, organizing body, committee, or individual. To the maximum extent permitted by law, each Provider is not liable nor responsible, in any circumstance, for any loss or damage incurred by any registrant or in respect of the registrant's property ( or property for which the registrant is responsible in any way ) including, but not limited to, loss or damage arising directly or indirectly from or relating to :
a) any disappointment or distress in relation to an Event or part thereof;
b) any negligent act or omission on the part of ICFA or any of the other Providers of any of their representatives or employees;
c) any unintentional inaccuracy or mis-description;
d) any delay, damage, loss, injury or death;
e) the use or misuse of any equipment, facilities or utensils at an Event whether provided by ICFA or otherwise;
f) any action or inaction and / or conduct of any parties associated with an Event, including , but not limited to, any Event venue organization or any of its representatives or employees;
g) any cancellation, change, disruption, or limitation to the Event programme or the provision of any other part of the Event as a result of any circumstance outside the reasonable control of ICFA or any of the other Providers; and
h) any loss or damage associated with registration for an Event.
Nothing in this clause or these Terms and Conditions derogates from the application of any mandatory legal requirement ( and to the extent there is any exclusion of liability in these Terms and Conditions not permitted by law in the country in which the Event occurs, then that exclusion shall be deemed varied or removed, as required, to avoid conflict with the law of the country concerned).
8.2 For those forms of liability, loss or damage that cannot be excluded by law, ICFA's maximum liability is limited to the cost of the registration fee.
9.1 Breach of any of these Terms and Conditions by a registrant entitles ICFA, at its sole discretion, to cancel a registrant's registration for an Event, whether the Event has commenced or not . The registrant will not be entitled to any refund in that event. Nothing in this clause limits any other right, remedy or recourse available to ICFA.
10.1 Registration fees do not cover insurance of any kind. It is recommended that registrants obtain adequate insurance cover for all risks that might arise from attendance at an Event including but limited to comprehensive travel, medical, event and other postponement, cancellation, legal liability and repatriation insurance.
11.1 If ICFA and the registrant cannot resolve a dispute within one calendar month of a claim or complaint first being made, the parties must refer the matter to mediation before issuing court proceedings ( other than injunctive relief ). The parties will agree on a third mediator to conduct the mediation. Failure to identify a mediator within 14 days of a request for that being received by the other from the requesting party will result in the other's claim ( if the claimant ) or defence ( if opposing the claim ) being deemed abandoned.
12.1 The law applying to these Terms and Conditions will be the law of the country in which the Event takes place and the courts of that country will have sole jurisdiction to determine any issue or claim relation to these Terms and Conditions.
